1. Terms and definitions

The terms and definitions used in this Agreement mean the following:
1.1. Television broadcasting communication network (hereinafter referred to as “STV”) is a communication network for the distribution of television broadcasting programs, which is the property of the Operator or is under its jurisdiction under other legal rights.
1.2. Subscriber line - a communication line connecting STV communication facilities through the Subscriber Distribution System with User (terminal) equipment
1.3. Subscriber distribution system - a set of physical circuits and technical means (including pass-through amplifiers, splitters, subscriber sockets and other switching elements) located at the subscriber's premises, through which user (terminal) equipment is connected to STV communications equipment.
1.4. Subscriber's premises - residential premises owned by the Subscriber or transferred to the Subscriber under a social tenancy agreement, as well as premises that are common property in an apartment building.
1.5. User (terminal) equipment - technical means(including a television receiver) designed for receiving, processing and reproducing television program signals.
1.6. Providing the Subscriber with access to STV is a set of actions by the Operator, which provides communication services for the purposes of cable broadcasting, to form a Subscriber Line and connect User (terminal) equipment to STV communication facilities with its help.
1.7. Services - communication services for the purposes of cable broadcasting (providing the Subscriber with access to the Operator's STV, distribution (delivery) of signals from television broadcasting and (or) radio broadcasting programs via a cable communication network to user (terminal) equipment, provision of a Subscriber line for permanent use, free broadcasting mandatory public television channels and (or) radio channels, the list of which is determined by law Russian Federation about the media).
1.8. A package of television program signals is a set of electrical signals of television programs, formed as a single whole, for the provision of Services on the basis of this Agreement, the list of which is brought to the attention of the Subscriber at the place of work with the Subscriber and (or) on the Operator’s website.

2. Subject of the agreement

2.1. This Agreement determines the procedure for the relationship between the parties when the Operator provides communication services for the purposes of cable broadcasting to the Subscriber. The relationship between the Subscriber and the Operator is regulated by the norms of federal legislation, the Rules for the provision of communication services for the purposes of television broadcasting and (or) radio broadcasting, approved by Decree of the Government of the Russian Federation of December 22, 2006 No. 785, and this Agreement.
2.2. This Agreement is a public offer. Acceptance of the offer is the payment by the Subscriber for the services provided in accordance with this Agreement. The terms of Art. 426 of the Civil Code of the Russian Federation and Art. 428 of the Civil Code of the Russian Federation.
2.3. This Agreement is the same for all STV Subscribers and is concluded for an indefinite period.

3. Conditions for concluding an agreement and providing access to STV


3.1. To conclude an agreement, the applicant submits an application to the Operator in the form approved by the Operator at the Operator’s office at the address: village Tomilino, st.Garshina 3B (Planet shopping center, floor 3). The application is an integral part of the concluded Agreement.
3.2. The operator, within a period not exceeding 30 days from the date of registration of the application for concluding an agreement, carries out a technical check of the technical possibility of providing access to the STV. The telecom operator has the right to refuse the applicant to conclude an agreement if there is no technical possibility of providing access to STV.
3.3. To provide access to STV and receive services, the applicant must have serviceable user (terminal) equipment and a Subscriber distribution system removed from the apartment in such a way that it can be connected to subscriber line STV Operator. The responsibility for ensuring the availability of the subscriber distribution system and user (terminal) equipment rests with the Subscriber.
3.4. Providing access to STV is carried out if technically possible, no later than 35 days from the date of submission of the application.
3.5. If there is actual access to the Operator’s STV and an individual makes payment for services in the manner provided for in Section 4 of this Agreement, it is considered that such individual by these actions he has acceded to this Agreement, accepts its terms, and therefore is a Subscriber of the Operator.
3.6. Unauthorized connection of the Subscriber Distribution System to STV communications facilities unacceptable. The person who made the unauthorized connection is liable in accordance with the current legislation of the Russian Federation.

4. Payment for services

4.1. The cost of the Operator’s services consists of: a one-time payment for providing the Subscriber with access to STV and monthly subscription fee according to the Operator's current price list.
4.2. Payment for services is made monthly until the 10th day of the month following the billing month according to the Operator's payment document at the Operator's payment acceptance points.
4.3. Payment can be made in advance for one or several months in advance. If the amount of the subscription fee (tariff) specified in the Price List changes during the advance payment period, the Subscriber shall make an additional payment within 30 calendar days from the date of indebtedness for the partially paid period.
4.4. In the event of the specified change in the Price List, the Operator notifies the Subscriber about this in any way available to the Operator, including through the media, in places of work with Subscribers (Operator’s offices), no later than 10 days before its implementation. Notification of the upcoming change in the Price List, transmitted by the media and (or) posted in places of work with the Subscriber, is considered received by the Subscriber (in accordance with the Rules for the provision of communication services for the purposes of television and radio broadcasting, approved by Decree of the Government of the Russian Federation of December 22, 2006 No. 785).
4.5. When payments are received, the Operator first repays the existing debt based on the date it arose, starting with the earliest one.

5. Rights and obligations of the parties

6.Maintenance

6.1. The operator, at his own expense, carries out routine maintenance and renovation work throughout STV. The Subscriber has no right to prevent the Operator from carrying out the specified work.
6.2. To carry out preventive (routine) work in STV, technological breaks are allowed in the form of a complete or partial interruption of the delivery of a package of television and radio program signals no more than once a month on weekdays for no more than 8 hours.

7. Procedure and conditions for suspension, modification, termination and termination of the Agreement

7.1. The Operator and the Subscriber have the right at any time, by agreement of the parties, to terminate the Agreement with mandatory notification to the other party within a month.
7.2. Refusal from the Operator's services is carried out on the basis of the Subscriber's personal application submitted to the Operator's subscriber department.

7.3. In the event of arrears in payment for services, the Operator may terminate the contract unilaterally by notifying the Subscriber in advance. In order to recover the debt, the Operator has the right to file a claim in court.
7.4. If there is a debt to pay for the Operator's services at the time of termination of the Agreement, the Subscriber is obliged to pay the existing debt no later than 10 (ten) days from the date of termination of the Agreement. In case of violation of this condition by the Subscriber, the Operator has the right to refuse the Subscriber to enter into a new Agreement until the actual payment of the debt, taking into account re-indexation on the day of payment.
7.5. After concluding an agreement to terminate the Agreement, the Operator’s specialist disconnects the subscriber distribution system from the Operator’s STV. In this case, the subscription fee is charged until the actual disconnection of the subscriber distribution system from STV communications.
7.6. Upon termination of the Agreement, the Subscriber undertakes not to interfere with the Operator in carrying out work to disconnect the subscriber distribution system from STV communications.
7.7. When performing work to disconnect the subscriber distribution system from STV communications, the Operator has the right to notify the Subscriber about this, and if there is no debt on the subscription fee, at the Subscriber’s request, issues a certificate in the form established by the Operator, confirming the fact of disconnecting the subscriber distribution system from STV.
7.8. The Operator has the right to unilaterally terminate the Agreement in the event of termination of the provision of the relevant Services, notifying the Subscriber of this no later than 30 (thirty) days before the date of termination of the provision of Services.

8. Responsibility of the parties

8.1. For failure to fulfill or improper fulfillment of obligations under this Agreement, the Operator and the Subscriber bear responsibility established by the current legislation of the Russian Federation, including the Rules for the provision of communication services for the purposes of television broadcasting and (or) radio broadcasting, approved by Decree of the Government of the Russian Federation of December 22, 2006 No. 785 and this Agreement.
8.2. The operator is not responsible for:
8.2.1. Work breaks active equipment STV caused by a loss of electricity supply to the Subscriber.
8.2.2. Interruptions in the operation of STV equipment associated with changes in atmospheric and meteorological conditions affecting quality
services, as well as for the consequences of the influence of force majeure circumstances on the provision of services.
8.2.3. Failure to provide services to the Subscriber for technical reasons due to late submission or absence of applications from the Subscriber.
8.3. The procedure for filing and considering claims arising in connection with the execution of this Agreement is determined by the Federal Law of the Russian Federation (On the Protection of Consumer Rights), the rules for the provision of communication services for the purposes of television and (or) radio broadcasting, approved by Decree of the Government of the Russian Federation dated December 22, 2006 No. 785.
8.4. This Agreement is drawn up in 2 copies having equal legal force, one each for the Operator and the Subscriber.
